With the uncertain times that we are in today with the Coronavirus (COVID-19), this treasured quote takes on a new meaning for me and my team at The Estate & Asset Protection Law Firm. KNOW THE FACTS

As there are many myths going around, we encourage everyone to get the facts about the about Coronavirus (COVID-19) from the Centers For Disease Control (CDC) (https://www.cdc.gov/coronavirus/2019-nCoV/index.html) and/or the Georgia Department of Public Health (https://www.cdc.gov/coronavirus/2019-nCoV/index.html) for the most recent updates, effective preventative strategies to minimize exposure, and what to do if you experience symptoms.

PREPARING FOR THE HEALTH AND FINANCIAL “WHAT IFS”

Once you have addressed your risk of exposure, continued relief and piece of mind will come from being prepared for the health and financial “what ifs”. If you have not already done so, please note that everyone over the age of 18 should have these three basic documents, regardless of their wealth or health:

  • A Financial Power of Attorney – This legal document would allow your agent to pay your bills, enter into and cancel contracts, and make other time-sensitive financial decisions if you are unable to make those financial decisions for yourself.
  • A Health Care Power of Attorney – This legal document would allow your agent access to your medical records, to be able to discuss medical treatment plans with your physician, and make medical decisions on your behalf if you were unable to make those health care decisions for yourself. This agent will also ensure that your very personal end of life decisions are honored.
  • A Will – This legal documents allows you to determine how your estate will be distributed, name a trusted person as an executor who will administer your estate through the Probate Courts, declare who will take care of your minor children, and allows you to establish your legacy by reflecting your personal values through gifts and donations.

To re-emphasize a point above, these basic estate planning documents are essential for anyone over the age of 18. If you have college age children, your parental rights terminate when they turn 18. That means that you are no longer legally able to act on their behalf concerning their financial and health care concerns unless they have powers of attorney in place concerning their health care and financials. If they don’t have health care directives and powers of attorney in place, give us a call to discuss.

Of course, after completion of these three basic documents, then you can consider a more thorough estate plan, like a Revocable Living Trust, Governmental Asset Protection Trust, or Asset Protection Trust – but that conversion can come after completion of the three basic documents.
