DECATUR, GA, June 9, 2023: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new article on the law firm’s website entitled “When To Use And What To Expect When Using Professional Fiduciaries.” Ms. Pawley expands the meaning of “fiduciary” beyond the financial profession.

According to Pawley, “Most people who have heard the term “fiduciary” typically think it applies only to financial advisors. However,” she continues, “the term encompasses much broader territory. Black’s Law Dictionary defines a fiduciary as a person “invested with rights and powers to be exercised for the benefit of another person.” So, as you can see,” she emphasizes, “fiduciary is a legal term that can apply to professionals as well as non-professionals legally designated as representatives entrusted with the care of property or funds. Depending on the complexities of your individual circumstances it may make more sense to hire professional fiduciaries from whom you can expect scrupulous good faith and candor.”

Pawley goes on to list the various roles which include Personal Representative, Conservator, Trustee, and Agent, Advisor, or attorney-in-fact. She explains these different roles as they apply to her specialty of estate planning and probate law.
