The Estate & Asset Protection Law Firm Owner, Shannon Pawley, acknowledges the desire parents have to leave their deeded property to their children and offers reasons for not putting their kids’ names on deeds along with alternate solutions.

DECATUR, GA, June ••, 2023: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitled “Avoid Probate And Avoid Putting Children’s Names On Deed.” Ms. Pawley supplies a list of solid reasons for not putting children’s names on deeds.

According to Pawley, “Many parents make the decision to put their children’s name on the deed to the family home during their lifetime thinking that this is the best way to avoid probate when they die.” She continues adding, “This might seem like a good idea and the home or property will not have to go through probate, but there are so many other consequences of this one action that will be of greater disservice to your children, and ultimately to you. Before you take this action,” Pawley encourages, “please consult with an experienced estate and asset protection attorney or an elder care attorney. And, please have a look at some of the reasons why transferring property to your children during your life may not be the best idea.”

Among the reasons Pawley offers are tax implications, loss of control, financial risks and the biggest of all is how it can affect Medicaid Eligibility.
