DECATUR, GA, March ••, 2024: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitledFunctions Of Powers of Attorney For Healthcare And Financial Decisions.” Ms. Pawley highlights the types of decisions POAs are authorized to make.

“When you begin the process of creating an estate plan,” Pawley writes, “one of the most important decisions you’ll make is the assignment of Powers of Attorney (POA) for healthcare and financial decisions should you be rendered unable to make decisions for yourself.” She continues, “When I work with clients, I go over all the possible scenarios needing consideration when making this kind of decision. I also go in depth on the types of decisions that can and cannot be made by those to whom you assign Powers of Attorney.”

Pawley acknowledges, “It’s important to remember that specific instructions will be put in writing defining the duties and responsibilities of each POA. Legally there are things a POA cannot do, for instance, the assigned POA cannot transfer his or her responsibility to another person at any time.” She adds, “The financial POA has a fiduciary responsibility to act in your best interest, and they cannot make decisions before the document comes into effect.”

As Pawley notes, “When selecting both, a healthcare and a financial POA, you must trust that person implicitly. Of course,” she adds, “whoever you select must agree to take on the responsibilities. This is the person (or persons) who will take over your medical care, financial management, possibly business responsibilities, and more. Understanding the rights and limitations of the Power of Attorney clarifies expectations as you navigate this process.”

Shannon earned her undergraduate degree at North Carolina Wesleyan College and pursued a law degree from Michigan State University College of Law.  After obtaining her law degree and becoming a licensed attorney in Michigan, she continued her educational pursuit by acquiring a LL.M. (Master of Law) in Taxation from Wayne State University. After moving to Georgia in 2018, Shannon obtained her Georgia law license and has enjoyed being able to pursue her desire of ensuring persons are able to age with dignity, grace and independence.
