Shannon Pawley, The Estate & Asset Protection Law Firm Owner, explains that an ancillary estate can be protected from ancillary probate in a thoroughly crafted estate plan.

DECATUR, GA, May ••, 2024: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitled “What Is An Ancillary Estate.” Ms. Pawley acknowledges that probate is a lengthy and expensive process and that ancillary probate can be even more time consuming and expensive.

Pawley explains that “An Ancillary Estate is property, often real estate, though it can also be tangible property such as vehicles, boats, or airplanes that are owned in a state other than the state in which the owner resides.” She goes on to add, “Such property, upon the owner’s death, then goes into a process known as ancillary probate which technically speaking is the administration of a decedent’s estate for the purpose of disposing of property owned in another state. Legally,” she continues, “ancillary probate administration is required for the assets to pass ownership to the beneficiaries.”

As Pawley notes, “There are ways to avoid ancillary probate just as there are ways of avoiding probate when everything you own is in your home state.” She elaborates. “The most common and effective way to avoid probate is to create a Living Trust within your estate plan. Assets and property owned by a Living Trust can pass to your beneficiaries directly without going through probate.  If you move your property into a Living Trust before you pass away, you won’t have to worry about that property going through probate or ancillary probate.”

Shannon earned her undergraduate degree at North Carolina Wesleyan College and pursued a law degree from Michigan State University College of Law.  After obtaining her law degree and becoming a licensed attorney in Michigan, she continued her educational pursuit by acquiring a LL.M. (Master of Law) in Taxation from Wayne State University. After moving to Georgia in 2018, Shannon obtained her Georgia law license and has enjoyed being able to pursue her desire of ensuring persons are able to age with dignity, grace and independence.
