DECATUR, GA, August 29, 2024: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitled “How To Protect Minor Beneficiaries From Themselves and Others Through Minor Trusts.” Ms. Pawley tells parents they can place age restrictions on trusts that go beyond 18.
Pawley writes, “One of the most effective ways to ensure that your assets are passed smoothly to your heirs is through a well-crafted Estate Plan.” She continues, “This goes beyond just having a Will. As I often emphasize in my seminars and panel discussions, everyone aged 18 and older should, at a minimum, have three essential estate planning documents: a Financial Power of Attorney, a Healthcare Power of Attorney, and a Will. For optimal protection, incorporating a trust strategy into your estate plan can provide added security and flexibility.”
As Pawley notes, “Another vital component is establishing a Minor Trust, which can limit or even prohibit access to the funds until your children reach a specific age.” Pawley explains, “You can choose any age that you believe is appropriate, such as 21, 25, 30, or even 40. Just as you can elect your personal age of financial responsibility,” Pawley adds, “you have control over how they will access the funds – monthly allowance, key year distributions, or limit the distribution to the Trustee’s discretion. This ensures that your children have access to the resources they need when they are mature enough to manage them responsibly.”

Shannon earned her undergraduate degree at North Carolina Wesleyan College and pursued a law degree from Michigan State University College of Law. After obtaining her law degree and becoming a licensed attorney in Michigan, she continued her educational pursuit by acquiring a LL.M. (Master of Law) in Taxation from Wayne State University. After moving to Georgia in 2018, Shannon obtained her Georgia law license and has enjoyed being able to pursue her desire of ensuring persons are able to age with dignity, grace and independence.
