DECATUR, GA, August 28, 2024: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new article on the law firm’s website entitledCommon situations that can lead a probate matter to become contested and how to proactively address them.Ms. Pawley’s aim is to help people avoid probate and the contesting of wills.

As Pawley states, “There’s no getting around it. We are all going to cease to exist someday. And it’s only natural that people want to pass on the fruits of their labors here on this earth to their loved ones.” She jokingly adds, “That’s one of the reasons lawyers exist!” She goes on to add, “Some of us create legal documents for clients that assign their assets to heirs and other loved ones. But” she continues, “the fact remains that many people are not happy with the contents of some wills and many times wills are contested by disgruntled heirs.” Pawley then states, “And, as if the probate process weren’t complicated enough, contesting makes it even more complicated, difficult and challenging for grieving families.”

“I have outlined five of the most common problems that typically lead people to contest a will and drag out the probate process,” writes Pawley. She continues, “I’ve also provided steps that can be taken to ensure that these problems do not arise, and if they do will quickly be nipped in the bud.”

Among the common issues that heirs find for contesting wills are, according to Pawley, wills that are outdated or not clearly written, family feuds and misunderstandings, and lack of testamentary capacity. She also provides specific solutions to each of the issues raised.
