DECATUR, GA, January 29, 2025: Shannon Pawley, Owner of The Estate & Asset Protection Law Firm, has posted a new blog on the law firm’s website entitled “The Role of Irrevocable Trusts in Protecting Assets from Creditors,” in which Ms. Pawley highlights the three ways an Irrevocable Trust protects assets.
“As part of an estate plan,” Pawley writes, “an irrevocable trust can provide important benefits.” She elaborates, “Irrevocable trusts protect assets from judgment creditors by transferring ownership of the assets to a trustee, who then manages them. This prevents judgment creditors from accessing the assets or satisfying judgments against the grantor.”
According to Pawley, “While an irrevocable trust is primarily used to protect assets from judgment creditors, it can also minimize estate taxes, and control how assets are distributed to beneficiaries by removing ownership from the grantor.”
Additionally, Pawley explains, “What makes an irrevocable trust a valuable tool is that once it is established the grantor cannot easily change the terms of the trust. In fact, only a court order can undo the transfer of assets in an irrevocable trust if it believes the grantor intended to defraud creditors.”
